Terms of Service

By accessing or using the Service, you confirm that you can form a binding contract with TestOwl, that you accept these Terms, and that you agree to comply with them. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

You must provide accurate and complete information when creating an account and keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately at our contact page if you suspect unauthorized use of your account.

Paid plans are billed in advance on a recurring basis (monthly or annually, as selected) through our third-party payment processor. Fees are non-refundable except where required by law or expressly stated otherwise. We may change our pricing with prior notice; continued use of the Service after a price change takes effect constitutes acceptance of the new pricing. You may cancel a subscription at any time, effective at the end of the current billing period.

You agree not to:

• Use the Service to test, access, or interact with systems you do not own or lack authorization to test;
• Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
• Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
• Upload malicious code, or use the Service to distribute malware or conduct unauthorized security testing;
• Circumvent usage limits, rate limits, or licensing restrictions associated with your plan; or
• Use the Service in a manner that violates any applicable law or the rights of a third party.

You retain ownership of the test scripts, recordings, configurations, and other content you upload or create using the Service (“Customer Data”). You grant TestOwl a limited license to host, process, and display Customer Data solely to provide and improve the Service. You are responsible for ensuring you have the necessary rights and permissions for any Customer Data you submit, including any third-party systems your tests interact with.

The Service, including its software, design, and branding, is owned by TestOwl and its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with your plan. No other rights are granted.

The Service may integrate with third-party platforms (e.g., CI/CD tools, issue trackers, identity providers) that you choose to connect. Your use of those integrations is subject to the third party's own terms and privacy practices, and TestOwl is not responsible for their availability, accuracy, or conduct.

From time to time we may make experimental or “beta” features available. Beta features are provided “as is,” may be changed or discontinued at any time without notice, and are excluded from any uptime or support commitments that may otherwise apply to the Service.

We may suspend or terminate your access to the Service if you materially breach these Terms, create risk or legal exposure for TestOwl, or fail to pay applicable fees, generally following notice and a reasonable opportunity to cure where practicable. You may stop using the Service and close your account at any time. Sections of these Terms that by their nature should survive termination (e.g., payment obligations, disclaimers, limitations of liability) will survive.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. TESTOWL DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TEST RESULTS WILL BE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTOWL AND ITS OFFICERS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO TESTOWL IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

You agree to indemnify and hold TestOwl harmless from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

These Terms are governed by the laws applicable at TestOwl's principal place of business, without regard to conflict of law principles, except where mandatory local consumer protection laws provide otherwise. Any dispute not resolved informally will be subject to the exclusive jurisdiction of the competent courts of that location, unless applicable law requires otherwise.

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by email before the changes take effect. Continued use of the Service after changes become effective constitutes acceptance of the revised Terms.
